Philippines: Closure of Nickel Ore Mines
It is reported that the Department of Environment and Natural Resources (DENR) intends to close 23 of the country’s 41 nickel ore mines, these include:
The 5 mines where operations have been suspended by the DNER are: Berong Nickel Corp; Citinickel Mines and Development Corp; Lepanto Consolidated Mining Corp; OceanaGold Phils and Strong Built Mining Development Corporation.
Members with vessels loading nickel ore in the Philippines should first ensure they are not loading from any of the listed mines as they may face allegations of “mineral theft”, leading to complications and subsequent delays.
Members should ensure when fixing their vessel that charterparties include an express warranty from their Charterers that the cargo to be shipped is legal and a wide indemnity covering all eventualities in the case that the cargo is subsequently found to be or alleged to be a prohibited cargo.
We take this opportunity to remind Members when fixing their vessel to load nickel ore of their obligation to report this to the Club. We would also draw attention to our circulars in relation to the safe carriage of nickel ore in the Philippines.
