Changes to Australian Pollution Law
The Australian Government recently passed amendments to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 to apply strict liability to bareboat, time or voyage charterers for oil pollution incidents.
These amendments, which are now in force, mean that in addition to the liability issues charterers can also face criminal charges for oil pollution regardless of any fault on their part. The penalties for oil pollution have also been increased from A$275,000 to A$11 million for a corporation.
While charterers may not have direct control over the operational activities of vessels which could result in pollution occurring, they are advised to ensure proper procedures in place covering all activities in which they are involved.
