International Group Standard Form Letters of Indemnity

CIRCULAR REF: 2010/031

CIRCULATED TO ALL MEMBERS, BROKERS AND DIRECTORS 

Members are referred to the circular (issued in a similar form by each of the International Group Clubs) on delivery of cargo under bills of lading without production of the original bills of lading dated 1st October 2010 and which can be found here.

It is hoped that the following will assist Members in following the guidance contained in that circular.

Amendment to standard wording:

In order to assist Members the wording which was recommended in the 1st October 2010 circular has now been inserted by us in the Standard Form Letters and, for reference only, are attached.  It will be noted that the amendment relates only to those letters which deal with delivery of cargo without production of a bill of lading i.e. the forms numbered1A, 1B, 3A and 3B in our Rule Book.

For the avoidance of doubt, and by way of example, if the request is to deliver the cargo to a company named Portco, the relevant part of the letter of indemnity would read “…deliver the said cargo to Portco or to such party as you believe to be or to represent Portco or to be acting on behalf of Portco…”

Timing of demands under the Letter of Indemnity:

We should also clarify that the recommendation in the 1st October 2010 circular as to timing of demands can be applied to all of the Standard Form Letters i.e. forms 1A, 1B, 2A, 2B, 3A and 3B in our Rule Book.
