Update - US Sanctions – Nordstream 2 and Turkstream

Reference is made to North Circular 2020/029 “Nordstream 2 and Turkstream – update on new US sanctions”, dated 18 September 2020.

On 1 January 2021, the United States Senate and House of Representatives passed the National Defense Authorization Act for 2021 (“NDAA 2021”).

Section 1242 of NDAA 2021 contains the Protecting Europe’s Energy Security Clarification Act referenced in the Circular. Members are asked to note that the new legislation authorizes the imposition of sanctions against persons / entities involved in specified activities relating to the construction of the Nord Stream 2 and the second line of the TurkStream pipeline projects. This will include vessels engaging in work related to the construction of the pipelines and the provision of insurance to such vessels.

Members are reminded that where the employment of a vessel creates a risk of the club being exposed to the risk of sanctions or other adverse action, cover will automatically cease in accordance with the rules.
